Annulment of decision refraining trial of Omar al-Assir

The Sixth Chamber of the Criminal Court of Cassation presided by Judge Joseph Samaha and members Judges Walid al-Qadi and Sabouh Hajj Sleiman, annulled on Friday the sentence of the Military Investigating Judge Nabil Wehbeh stipulating the refraining the trial against Omar Ahmad al-Assir.

The Court ordered the acceptance of the summon submitted by the Government Commissioner to the Military Court Judge Saqr Saqr, the annulment of the appealed sentence and referring the file to the First Military Investigating Judge after obtaining a familial civil abstract of Omar Ahmad al-Assir register No. 95/Sidon, in order to identify Sheikh Ahmad al-Assir and therefore determine the concerned party in the trial of the defendant, Omar al Assir, born in 1997.

Judge Saqr had issued a warrant Wednesday [Novemeber 14] against the son of the Salafist Sheikh over violently resisting a police checkpoint whilst illegally driving in Sidon.

Members of the police had ordered Omar to stop his car for driving an unauthorized vehicle with tinted windows.

Several cars carrying armed men arrived to free Omar by force after he called for their help leading to confrontations with the police.
